NUMBERS AND COMMISSIONERS

These are 16 railway infrastructures, 14 roadways, 12 public safety barracks, 11 water works, 3 port infrastructures and a metro, for a total value of 82.7 billion euros (21.6 billion in the North, 24.8 billion in the Center and 36.3 billion in the South) financed, under current legislation, for about 33 billion euros. The funding will be complemented with additional national and European resources, including the Next Generation EU.

WHAT THE GOVERNMENT HAS DECIDED

With the Dpcm signed by the President of the Council of Ministers, following the positive opinion expressed by the competent committees of the Chamber and Senate, the procedure provided for by the decree-law n.76 of July 2020 officially starts, even if several Commissioners have already started the activities. In this way, it will be possible to shorten the time needed to carry out important infrastructural interventions that have been expected for years in various areas of the country, especially in the South. The Commissioners are highly professional technical-administrative figures, immediately operational, chosen to ensure the best dialogue with the contracting stations of ANAS and RFI and with the various public administrations involved. Only in one case, as foreseen by a Cipe resolution, was the President of the Sicilian Region appointed as extraordinary commissioner.

TYPES OF INTERVENTION

As regards the types of interventions subject to the commissioner, the railway infrastructures have a value of 60.8 billion, the road ones 10.9 billion, the public safety structures 528 million, the water works 2.8 billion, the port infrastructures 1 , 7 billion, the subway 5.9 billion. To speed up the implementation of these interventions, in December 2020 a Memorandum of Understanding was signed with the trade unions which provides for the optimization of 24-hour work shifts.

THE TIMETABLE

The state of implementation of the infrastructures is different. For some works the commissioner will allow the planning to be started, for others the quick start of construction sites. On the basis of the time schedules available, 20 construction sites are expected to open in 2021, to which 50 will be added in 2022 and a further 37 in 2023. The construction of the commissioned works will have a significant impact on employment levels: according to an assessment conducted by RFI and Anas, the employment impact of railway and road works alone can be estimated at over 68,000 average annual work units over the next ten years, with a growing profile until 2025, the year in which a direct impact on employment of over 100,000 work units.

Those that are "released" are works characterized by a high degree of planning complexity, by a particular executive or implementation difficulty, by the complexity of the technical-administrative procedures or which have a significant impact on the socio-economic fabric at national, regional or local level. Some of the works were partly already planned in the "Fast Italy" document, attached to the 2020 Economics and Finance Document and also find correspondence in the proposal of the Ministry of Sustainable Infrastructures and Mobility for the National Recovery and Resilience Plan (Pnrr). The main railway works subject to the commissioner include: the HS / HC lines Brescia-Verona-Padua, Naples-Bari, Palermo-Catania-Messina; the strengthening of the Orte-Falconara and Rome-Pescara lines; the closure of the railway ring of Rome; the enhancement with HS characteristics of the Taranto-Metaponto-Potenza-Battipaglia route. The main road works include: the SS Ionica 106; the E 78 Grosseto-Fano; the SS 4 Salaria and the SS 20 of Colle di Tenda; the SS 16 Adriatica; the SS 89 Garganica. The public safety devices will be built in Palermo, Catania, Reggio Calabria, Crotone, Naples, Bologna, Genoa and Milan. The other interventions concern the Peschiera aqueduct and numerous dams in Sardinia, the ports of Genoa, Livorno and Palermo.

GIOVANNINI: IN THE NEXT WEEKS A NEW LIST OF WORKS TO BE COMMISSIONED

“As announced in Parliament – adds Minister Giovannini – I will propose in the coming weeks a new list of works to be commissioned, but it must be remembered that the commissioner is an extraordinary act. For this reason, we have developed a series of regulatory and procedural interventions aimed at redefining the existing rules for the construction of infrastructures, starting from those envisaged in the National Recovery and Resilience Plan. The Commission we set up a few weeks ago with Minister Brunetta has completed its work and the numerous proposals made to speed up the paths of all public works are now being examined by the competent offices ”.

The Extraordinary Commissioners, who are responsible for every decision for the start or for the continuation of the works, provide for the possible re-elaboration and approval of the projects not yet contracted, together with the Interregional Superintendencies for public works and through specific protocols for the application of best practices . It is envisaged that the approval of the projects by the Commissioners, in agreement with the Presidents of the territorially competent regions, will replace by law any authorization, opinion, visa and clearance necessary for the start or continuation of the works, except and for those relating to environmental protection and cultural and landscape heritage, for which a specific discipline is defined.

For the execution of the interventions, the Extraordinary Commissioners can directly assume the functions of the contracting authority and operate in derogation from the provisions of the law on public contracts, without prejudice to compliance with a series of principles and provisions, including those relating to '' award and execution of contracts and concessions, energy and environmental sustainability, conflict of interest. In addition, a further limitation is that relating to the provisions of the code of anti-mafia laws and prevention and subcontracting measures.
