On August 18, 2021, the book written jointly by prof. Paolo Becchi and by the lawyer Giuseppe Palma, entitled: “ Justice, what reform? A liberal and guaranteed route ( with the text and detailed explanation of the six referendum questions ) ".

After the approval of the Court of Cassation in autumn 2021, the go-ahead also from the Constitutional Court arrived in February 2022, but the questions, which initially were 6, have become 5 (the one on direct civil liability was declared inadmissible of the magistrates).

We will vote only on Sunday 12 June 2022 , together with the first round of the administrative elections. Since this is an abrogative referendum , for this to be valid, it is necessary that 50% plus one of those entitled to vote go to vote.

The book by Paolo Becchi and Giuseppe Palma , in addition to addressing the issue of justice as a whole, explains in detail the meaning of all the referendum questions , offering the reasons for voting Yes on Sunday 12 June.

SYNOPSIS :

Reforming justice through the instrument of the abrogative referendum. This book explains in detail the meaning of the referendum questions proposed by Lega and Radicali in matters of judicial order and criminal trial. He argues for the reasons why it is necessary to first sign to exceed the threshold of five hundred thousand subscriptions (by the end of September 2021) and then, in the spring of 2022, to go and vote Yes for the repeal of the rules that are the subject of all six questions. At a time when fundamental rights seem no longer to be taken for granted, the institution of the referendum referred to in art. 75 of the Constitution can serve to restore the authentic meaning of the democratic principle. The authors put forward their proposals on immunity, wiretapping, precautionary measures, prescription, tracing a liberal and guarantee course not only in the context of civil and criminal justice reform, but also in the
revision of the Constitution and the judiciary. The political significance of the referendums is clear: to put an end to the overwhelming power of the prosecutors and remove absolute power from the prosecutors. If not now, when?

Paolo Becchi (Genoa, 1955) is full professor of philosophy of law in the jurisprudence department of the University of Genoa, where he teaches practical philosophy and bioethics.

Giuseppe Palma (Ostuni, 1978) is a lawyer and writer and has been practicing law for over ten years, with a second studio in Milan where he lives and works.
