ENERGY-POWERING COMPANIES: TAX CREDIT AT 20%

The innovations of the Energy decree first of all provide for an extraordinary contribution for energy-intensive companies based on the tax credit which concerns only companies that have experienced an increase in the cost per kWh of more than 30 percent in 2019: in this case the tax credit is equal to 20 per cent of the expenses incurred for the energy component purchased and actually used in the second quarter of 2022. All this for 700 million euros of higher charges.

INCOMING CUT FOR BILLS SYSTEM CHARGES

There is a new cut for bills in the second quarter of 2022: the draft provision provides that Arera cancels "the rates relating to general system charges applied to domestic users and non-domestic users in low voltage, for other uses, with available power up to 16.5 kW. To this end, additional resources amounting to 1,800 million euros are transferred to the Cassa per i energy e environmental services (CSEA), by 31 May 2022 ”. To reduce the effects of price increases in the electricity sector, ARERA also cancels, for the second quarter of 2022, "the rates relating to general system charges applied to users with available power equal to or greater than 16.5 kW, also connected in medium and high / very high voltage or for public lighting or charging electric vehicles in places accessible to the public. To this end, additional resources of 1,200 million euros are transferred to the CSEA by 31 May 2022 ".

REDUCTION OF VAT AND GENERAL CHARGES IN THE GAS SECTOR

The administrations of methane gas used for combustion for civil and industrial uses "accounted for in the invoices issued for the estimated or actual consumption of the months of April, May and June 2022, are subject to the VAT rate of 5 percent". Furthermore, "if the supplies referred to in the first period are accounted for on the basis of estimated consumption, the VAT rate of 5 per cent is also applied to the difference deriving from the amounts recalculated on the basis of actual consumption referable, also as a percentage, to the months of April , May and June 2022 ". In this case, the cost is calculated at 591 million. For the second quarter of 2022 "the effects of price increases in the natural gas sector, ARERA will reduce, for the same quarter, the rates relating to general system charges for the gas sector up to the amount of 480 million euros ".

STRENGTHENING OF THE ELECTRICITY AND GAS SOCIAL BONUS

For the second quarter of the year 2022, the concessions relating to the tariffs for the supply of electricity granted to economically disadvantaged domestic customers and to domestic customers in serious health conditions and the compensation for the supply of natural gas "are redetermined by ARERA, in order to minimize the increases in supply costs, expected for the second quarter of 2022, up to the amount of 500 million euros ".

EXTRAORDINARY CONTRIBUTION, IN THE FORM OF A TAX CREDIT, IN FAVOR OF COMPANIES WITH A HIGH CONSUMPTION OF NATURAL GAS

Companies with a high consumption of natural gas "are granted an extraordinary contribution, in the form of a tax credit, equal to 15 per cent of the costs incurred for the purchase, in partial compensation of the higher costs incurred for the purchase of natural gas. of the same gas, consumed in the first quarter of the year 2022, for energy uses other than thermoelectric uses, if the reference price of natural gas, calculated as the average, referring to the same quarter, of the reference prices of the Intra-day Market (MI- GAS) "" has undergone an increase of more than 30% of the corresponding average price referred to the first quarter of 2019 ".

“It is a company with a high consumption of natural gas that operates in one of the sectors referred to in Annex 1 to the decree of the Minister of Ecological Transition of 21 December 2021, the adoption of which was communicated in the Official Gazette of the Italian Republic no. 5 of 8 January 2021 and consumed, in the first calendar quarter of the year 2022, a quantity of natural gas for energy uses not less than 25% of the volume of natural gas indicated in Article 3, paragraph 1, of the same decree, at net of the consumption of natural gas used in thermoelectric uses ". The charges are valued at € 522.2 million for the year 2022.
