WHAT DOES THE GOVERNMENT DECREE PROVIDE?

The Council of Ministers extended the state of emergency for Covid to January 31, 2021, with a resolution. It also approved, as part of the Covid decree law, a rule that extends the dpcm with the anti-contagion rules now in force on 15 October. With a novelty: the obligation to wear masks even outdoors becomes effective immediately, if you are close to people who do not live together.

A new dpcm will therefore have to be adopted by October 15 to confirm or update the anti-contagion rules that would have expired today and which are instead extended. The mask is mandatory in all closed places, except private homes. This is the novelty that, according to what Ansa learns , was introduced by the Council of Ministers in the new Covid decree.

The obligation indoors was envisaged only for places open to the public: now a further squeeze arrives and the obligation is triggered everywhere except in one's home.

The obligation to wear a mask will apply "in all outdoor places except in cases where the condition of isolation is continuously guaranteed" from other people. According to government sources, this is the provision adopted by the Council of Ministers and relating to the new obligation that will be in force immediately after the publication of the Covid decree law in the Official Journal.

The obligation does not apply if you are outdoors in an isolated place with people living together.

OUTDOOR MASKS

The masks also become mandatory "outdoors when you are close to other people not living together". Without prejudice to "the anti-contagion protocols envisaged for specific economic and productive activities, as well as the guidelines for the consumption of food and drinks". The ban does not apply to children under the age of six, those who play sports and people with pathologies and disabilities not compatible with the use of the mask.

The single national Immune platform for the alert of subjects who have come into contact with positive people at Covid can remain operational until 31 December 2021 (no longer 31 December 2020). After that term, all personal data must be "deleted or made permanently anonymous". Immuni will also be able to communicate with other European platforms, so tracking will continue abroad for those traveling to Europe.

WORK

With the extension of the state of emergency, the incentive to smart working also remains for all jobs that can apply it. For cinemas, theaters and concerts, the limit remains of 200 people for indoor shows and 1000 people for outdoor ones.

FINES

To date, the fines for those who do not respect the limitations imposed by the anti-contagion rules range from 400 euros to 1000 euros. In the first phase of the lockdown, the maximum ceiling was 3,000 euros but then in May the Parliament reduced the maximum penalties. Those who have contracted Covid but do not respect the quarantine can incur a criminal sanction with arrest from 3 to 18 months, as well as a fine from 500 to 5,000 euros.

POLES TO THE REGIONS

The regions, according to the new Covid decree law, can only adopt more restrictive anti-contagion measures than those established by the government's dpcm. They can adopt "expansive" ones, therefore more permissive, only in cases where the dpcm expressly foresee it and after obtaining the assent of the technical-scientific committee. In any case, the Regions must "simultaneously inform the Ministry of Health".

PADS REQUIRED

Those arriving in Italy from Great Britain, Holland and Belgium will have to undergo the mandatory tampon. Today, the obligation of the molecular or antigen test with the swab is foreseen for those arriving from Croatia, Greece, Malta, Spain, as well as from Paris and seven other regions of France.
