WHAT THE PDL PROVIDES FOR ON THE USE OF FACIAL RECOGNITION IN PUBLIC PLACES

Article 1 of the proposed law provides for the suspension of the use of video surveillance systems with facial recognition "through the use of biometric data referred to in Article 4, No. 14 of Regulation (EU) 2016/679, in places public or open to the public, by public authorities or private entities ".

STOP UNTIL THE ENTRY INTO FORCE OF A STATE LAW

According to the PDL, the moratorium lasts "until the entry into force of a state law, and in any case no later than 31 December 2021, which, having acquired the opinion of the Guarantor for the protection of personal data, regulates the conditions of admissibility, and guarantees in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, of the code regarding the protection of personal data referred to in Legislative Decree 30 June 2003, n. 196 and subsequent amendments, as well as by Directive (EU) 2016/680 of the European Parliament and of the Council, of 27 April 2016, as implemented by the legislative decree of 18 May 2018, n. 51 and in any case in compliance with the proportionality principle envisaged by Article 52 of the Charter of Fundamental Rights of the European Union ".

FACIAL RECOGNITION SYSTEMS EXCLUDED FROM THE MORATORY

"The suspension referred to in paragraph 1 does not apply to video surveillance systems authorized according to current legislation" reads the bill signed by dem.
