With the decree on building bonuses approved yesterday, the Council of Ministers intervened on the superbonus , on the earthquake bonus and on incentives for the removal of architectural barriers.

WHAT THE DECREE ON BUILDING BONUSES PROVIDES

The tax credit will be recognized for all works carried out and certified by 31 December 2023; for works still to be carried out, the 70% bonus was confirmed. Individuals with an ISEE of less than 15 thousand euros, significantly increased based on the members of the family unit, are guaranteed a 110% credit also for the portion of work not certified as of 31 December.

WHAT CHANGES FOR THOSE WHO HAVE BENEFITED OF THE SUPERBONUS

In essence, those who have not completed the work within the year will not find themselves in the position of having to repay all the credits accrued up to that point. Secondly, for works not completed by 31 December and to compensate for the share which will drop from 110 to 70%, the State will intervene using the poverty fund with the right to increase its capacity during the financial year. In this way the less well-off groups will not have to bear the difference.

“For low incomes with ISEE up to 15 thousand euros, the decree provides for a sort of extension of the 110% benefit: this involves the establishment of a poverty fund which will cover expenses incurred from 1 January to 31 October 2024 and not covered more by the subsidy at 110% but only at 70%. CLOSE ON THE SISMABONUS…

The transfer of credit is excluded in the case of demolition and reconstruction interventions in seismic areas for which the qualification has not been requested on the date of entry into force of the legislative decree. More detailed checks are therefore included to limit the benefit only to buildings actually damaged by seismic events.

… AND ON THE ANTI-ARCHITECTURAL BARRIERS BONUS

The interventions subject to the subsidy are limited by clarifying which ones are referred to. A specific certification is required to comply with the requirements, to guarantee that the works are actually carried out to remove architectural barriers. From January 1, 2024, the transfer of credit is permitted for the common areas of condominiums for residential use and for natural persons with incomes of less than 15 thousand euros. The income limit does not apply to people with disabilities, thus maintaining their total protection.

“In the heat of the moment the opinion is positive. We have not yet seen the provision in its entirety, but from what we understand the effort made to facilitate the weakest groups is commendable". Federica Brancaccio, president of Ance, explains this, commenting on the provision on the Superbonus in two interviews, with La Stampa and QN . “The family income threshold is very low. The only fear is that it is not easy within a condominium to decide that someone will have to pay and someone won't – he explains to La Stampa -. Another fear is that the problem of the construction sites that are nearing completion will not be resolved. The risk is that at least some will remain open but unfinished." Finally, the president of Ance specifies to QN that "this sort of shield, it is not clear whether it is generalized or only for low incomes, risks leaving the work half done and leaving the condominiums without an end to the work – she concludes -. We hoped for a three-month extension for those who were nearing completion, without helping those who started two months ago. It was an easier route. This, however, risks missing the target"

There are 13 billion unfinished jobs at stake. Only a very small part of these will still be able to take advantage of the 110% and only for specific families: those with a "reference income" of up to 15 thousand euros to which the family quotient introduced for the villas can be applied. Provided that at least 60% of the work has been completed by December 31st. It means 15 thousand euros of income for a single person. And a maximum of 36 thousand euros for two parents with a dependent child. But the already existing "poverty fund" – introduced in the transition between 110 and 90% which occurred this year – is not refinanced to support these "less well-off groups", as Palazzo Chigi defines them. There are just 16 million of the 20 allocated there. Here only 0.3% – 50 million jobs out of 13 billion – will retain 110%. The others will drop to 70% coverage. This is why Ance was asking for selective intervention to help only those 30 thousand condominiums and those 300 thousand families close to the end of the works and not at fault for the delays. It was not so. The government has preferred a total amnesty for 2023: all pieces of work done, even if not energy efficient, will be repaid by the State with 110%. The final part of the works will instead be postponed to 2024, unless the construction sites are left halfway through. And next year the discount drops to 70%. Condominium feuds with unpredictable outcomes will open up over who will pay the 40% difference. Disputes will be the most popular route, thanks to the amnesty introduced by the government for 2023. If no one risks having to pay back the money or, worse, having their property mortgaged, then they will try to go for broke. It is difficult to avoid a paralysis of the work in progress.
