The disputes and poisons that started from the Milan Public Prosecutor's Office and reached the High Council of the Judiciary forced the vice president David Ermini and the Attorney General of the Cassation Giovanni Salvi to intervene with two official notes. Enough to understand what new wave of discredit is overwhelming the administration of justice. "The CSM is completely unrelated to opaque and destabilizing maneuvers", assures Ermini who denounces "a work of delegitimization and conditioning aimed at fueling citizens' distrust of the judiciary". Salvi speaks instead of "serious violations" on which his office will open a disciplinary investigation.

In this climate, the Public Prosecutor's Office of Rome investigates to find out how and why the secret reports of Piero Amara – the already convicted and pluri-investigated lawyer who spoke of politicians, entrepreneurs, leaders of law enforcement agencies and judges belonging to the alleged Masonic lodge blanket called "Hungary", capable of conditioning appointments and business – have been disseminated casting shadows on the leadership of the Milanese prosecutor. The employee of the CSM (now suspended) Marcella Contrafatto, suspected of being the "crow" for having sent copies of those papers to two newspapers and to the member of the CSM Nino Di Matteo, is being investigated for slander: in the anonymous accompanying letter accuse the Milanese investigators of not having wanted to investigate the reported lodge of Amara and its plots.

But the investigation must also ascertain whether the Milanese prosecutor Paolo Storari, who sent the minutes out of his office and delivered them to the then member of the CSM Piercamillo Davigo, committed a crime by violating the secret; what use did Davigo himself, to whom Storari had denounced the inaction of the Public Prosecutor's Office; and above all who are the principals of the subsequent and certainly illegitimate dissemination of those papers.

To do this, we must go back to the origin of the story when, in April 2020, Davigo receives the minutes from Storari. Shortly after he turns to Salvi who in his note yesterday writes: "In late spring he told me that there were disputes in the Milan Public Prosecutor's Office about a very delicate dossier, which also concerned other Public Prosecutors and which, according to a substitute, remained firm ". The substitute was precisely Storari. In the same days Davigo also talks to Ermini, but generically, about an investigation involving important names. Only later did he specify the existence of disputes within the Milanese prosecutor's office. Neither he nor Storari, however, present a formal complaint, as many do. The CSM cannot therefore intervene. Unlike the pg Salvi who now reconstructs: "I immediately informed the Milan prosecutor Francesco Greco." The two agreed on a meeting: "On June 16, Dr. Greco informed me in broad terms of the situation and the initiatives taken." A meeting was decided with the prosecutors of Rome and Perugia, to which the interrogations of Amara had been sent by competence, and "the coordination proved fruitful."

Salvi, however, clarifies that he never knew that Davigo had received from Storari the minutes that were the subject of so much fibrillation. He found out two weeks ago, when the Rome prosecutor Michele Prestipino and the deputy Paolo Ielo go to the CSM to search the office of the Counterfeit employee, former Davigo's secretary. "It is in itself – underlines the pg of the Cassation – a serious violation of the duties of the magistrate, even more serious if the anonymous dissemination of the minutes were to be ascribed to the same origin".

Davigo's behavior (who no longer sits at the CSM since October due to retirement, after trying to stay in his post and proposing an appeal against exclusion) is one of the unknowns of this story. Perhaps the decisive one: because he did not tell Storari to present a regular complaint to the Council, as had done a year earlier by the prosecutor of Rome Stefano Fava, who came into conflict with the prosecutor Giuseppe Pignatone and the adjunct Paolo Ielo precisely on matters relating to the investigations about Amara? For the subsequent dissemination of that complaint, Fava ended up under disciplinary and criminal investigation, but Davigo – who denies violations of secrets and claims the correctness of his actions – justifies himself with another argument: "I had to send that material to the First Committee of the CSM, where I believe sat a member who was mentioned in the papers? ».

The allusion is to Sebastiano Ardita, a councilor who was Davigo's current companion with whom, however, relations have been interrupted for over a year. And yesterday Nino Di Matteo, who after receiving the minutes of Amara with the name of Ardita, spoke about it with him and then with the Prosecutor of Perugia, took sides in his defense: «The statements on the councilor Ardita are clearly slanderous. Their falsity is easily found. The unlawful dissemination of those minutes also within the CSM represents a real dossier aimed at discrediting the director Ardita and influencing the activities of the Council ». Ermini also speaks of conditioning when he asks for "the most firm and resolute investigation by the judicial authority, in order to ascertain who is in charge of this whole operation".

EXTRACT FROM AN ARTICLE FROM CORRIERE DELLA SERA ON DIASORIN:

The sums earned on the stock market before April 7, 2020 – at least those "spotted" by the radar of the Prosecutor's Office and Consob – are really modest. But – if the reconstruction of the Supervisory Authority and prosecutors is correct – the abuse of privileged information in the purchase and sale of shares of the pharmaceutical company Diasorin spa, right in the middle of the Covid pandemic and right around the diagnostic swab that Diasorin was developing in collaboration with the Policlinico San Matteo in Pavia, an unpleasant page appears. Especially for those who are now challenged by a "notice of conclusion of the investigations" for the hypothesis of the crime of insider trading, notified by the Milan Public Prosecutor to the president of the Irccs Policlinico San Matteo di Pavia, Alessandro Venturi, and to the administrator Diasorin's delegate, Carlo Rosa. For what? For the privileged news destined to raise the share price by 5.7% (the validation of the diagnostic test and therefore its launch to marketing) given before the official press release to the market on 7 April 2020 from Rosa to his friend Carlo Ciceri; and from Venturi to the former commissioner of the Lega in Varese and president of the IRCSS Carlo Besta of Milan upon appointment of the Region; who in turn would have shared the information with a councilor of the Besta hospital close to the current minister Maria Stella Gelmini, Francesco Bombelli.

According to prosecutors Stefano Civardi and Giordano Baggio, and Consob, by buying and selling Gambini almost immediately, he earned 1,500 euros in six days, Bombelli in two days 1,300 euros, Ciceri 2,700 euros in two transactions. For those who blow the news (primary insider) the law provides for criminal penalties, while those who use it by buying or selling (secondary insider) fall under Consob administrative penalties.
