A real estate agency, La Prima Srl, based in Milan, offered its services to the owner of a property using LinkedIn contacts. Following the report by the complainant and the infringement detected, the Privacy Guarantor issued a warning to the agency, inviting it to appropriate organizational measures.

THE MEASURE

The Authority considered the measure sufficient and proportionate, considering the fact that it is a small company, exposed to the economic crisis caused by the pandemic, that there are no further proceedings against it and that it was a single direct contact to the complainant without involving the disclosure of personal data.

The agency, however, had to suffer a fine of 5,000 euros for failing to respond to the repeated requests for information from the Guarantor, making it necessary to notify through the special privacy unit of the Finance Police.

BECAUSE THE AGENCY HAS SUFFERED A SANCTION

The Guarantor reiterated that the communications made and received within a social network are aimed solely at what is established in the conditions of use of the service.

LinkedIn, specifically, has as its purpose the exchange of contacts in order to provide job opportunities and not to foresee that users of the social network could use the platform to send messages to other users with the aim of selling products or services, even if in this consists of one's own work activity.

WHAT THE AUTHORITY HAS ESTABLISHED

In this context, the Authority notes, “the fact that a user's profile is open or not to receive contacts from other users of the social network does not matter. What matters is the purpose – in this case promotional – for which the message was sent, a purpose which is in contrast with that envisaged in the contractual conditions for joining the social network ”.
