The Agency recalled in the document some of the conditions required by Note IIbis in art. 1 of the Tariff, part I, attached to Presidential Decree 131/86 to access the first home subsidy, which allows you to apply, to the deeds of transfer for consideration of "non-luxury" homes (other than A / 1, A / 8 o A / 9):

– the registration tax at 2% (and the mortgage and cadastral taxes in the fixed amount of 50 euros each) if the deed is subject to the proportional registration tax;

– 4% VAT (and mortgage and cadastral taxes in the fixed amount of 200 euros each) in the case of deeds "subject to VAT" (pursuant to art. 40 of Presidential Decree 131/86).

The financial administration, in particular, took the opportunity to remember that the facilitation can be applied on condition that: in the deed of purchase, the buyer declares that he is not the sole owner or in communion with the spouse of the rights of ownership, usufruct, use and residence of another house in the territory of the Municipality where the property to be purchased is located; in the deed of purchase, the buyer declares that he is not the owner, not even for shares, even under the legal communion regime throughout the national territory, of the rights of ownership, usufruct, use, dwelling and bare ownership over another house purchased by the same subject or by the spouse with the first home benefits.
