Far be it from us to praise this package of rules (moreover in the ''stamping'' phase) as President Giorgia Meloni did in a video. However, we are convinced that, beyond the alleged primacy claimed by the government, a provision like the one launched on May 1st comes from the same bag that governments have drawn on in recent years to deal with the various emergencies that have occurred.

THE MODIFICATIONS TO THE CONTRACT FORWARD IN THE WORK DECREE

Gianfranco Polillo, in an editorial in Start Magazine , has already commented, for his part, on the ''incomprehensible'' criticisms of the CGIL and Pd regarding the cut in the contribution wedge. We limit ourselves, therefore, to talking about another matter – the changes to the rules on fixed-term contracts – which now seem to have become the casus belli for a possible general strike.

It is on the basis of what will be established in this matter that the carefree Elly Schlein goes around saying that the decree will fuel poorly paid precarious work, making it easier for companies to resort to fixed-term hiring; this while the smartest and least rough among these ''snack companions'' recognize that a process of stable work increase and a contraction of fixed-term work is underway in the flows. Consequently, the decree would go against the trend of the evolution of the labor market, reopening the doors to a ''precariat'' in decline.

This is not Landini's position, who, regardless of all the statistical data, did not hesitate, in the May Day rally in Potenza, to rewrite article 1 of the Constitution in the following terms: Italy is a Republic founded on labor exploitation.

GREATER FLEXIBILITY: WHAT IS IT?

The reality is more complex and deserves to be told. We know the vulgate. According to reports, the provisions of the Meloni/Calderone decree tend to facilitate – compared to the provisions of the dignity decree launched in 2018 by the Conte 1 government signed by Luigi Di Maio (not yet Gigi of Arabia) – the continuation from 12 to 24 months (as the maximum limit) for fixed-term contracts where the extension or renewal corresponds to the requirements contemplated by the law.

The foreseen conditions (causality) were the following: a) temporary and objective needs, extraneous to the ordinary activity, or needs to replace other workers; b) needs related to temporary, significant and non-programmable increases in ordinary activities».

What does the "greater flexibility" boasted of by an incautious government and stigmatized by trade unions that don't know where to turn to motivate a general strike against precariousness consist of? So here are the new causes: The contracts may have a duration of more than 12 months, but not more than 24 months: in the cases provided for by collective agreements; for technical, organizational or production needs, identified by the parties, in the event of failure to exercise collective bargaining, and in any case by the deadline of 30 April 2024; to replace other workers.

So where is the increased precariousness when the causes must be provided for by collective agreements?

THE "CAUSALONE"

But there is another aspect to note: in the Meloni decree, in the absence of contractual discipline, the so-called causalone is reintroduced; i.e. those ''technical, organizational or production needs'' which had created so many problems for companies to resort to fixed-term contracts, precisely because the extreme vagueness of the motivation gave rise to so many disputes at the end of the relationship to be recognized by the judge the transformation of the contract into an indefinite period.

The Poletti decree intervened in 2014 to abolish the ''causalone'' with the aim of liberalizing the use of fixed-term work – under certain conditions – up to 36 months. The Meloni decree then restores that norm (the causalone, in fact) that a center-left government had adopted. It will be said that it was the Renzi government, now abjured by Elly Giovanna d'Arco's Pd who, like the maiden from Orleans, ''hears the voices'. It fell to Conte 2 – in the so-called relaunch decree – to suspend their application, in agreement with the unions, when it became clear – also due to the pandemic – that those rules were harmful to employment, since they forced companies to proceed with the hiring of new fixed-term contractors, after 12 months under the acausality regime. In fact, they were mostly young people hired on fixed-term contracts (about one million) who, upon expiry, found themselves out and about during the pandemic.

Here is the rule: Provision concerning the extension or renewal of fixed-term contracts 1. Notwithstanding article 21 of legislative decree 15 June 2015, n. 81, to deal with the restart of activities as a result of the epidemiological emergency from Covid-19, it is possible to renew or extend until 30 August 2020 the existing fixed-term employment contracts even in the absence of the conditions referred to in article 19, paragraph 1, of the legislative decree 15 June 2015, n. 81.
